1. Acceptance of Terms

By accessing or using MetaMuses ("Platform"), including our website, smart contracts, and AI companion services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Description of Services

MetaMuses provides:

  • NFT minting services for AI companion collectibles on the Metis blockchain
  • AI companion deployment with customizable personality traits
  • Interactive chat functionality with AI companions
  • A plugin marketplace for companion extensions
  • Blockchain-based ownership and verification systems

3. Eligibility

To use our Platform, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using blockchain services in your jurisdiction
  • Have a compatible Web3 wallet (e.g., MetaMask)

4. User Responsibilities

You agree to:

  • Maintain the security of your wallet and private keys
  • Provide accurate information when interacting with the Platform
  • Comply with all applicable laws and regulations
  • Not use the Platform for illegal or unauthorized purposes
  • Not attempt to manipulate, hack, or disrupt the Platform or smart contracts
  • Not use automated systems or bots without our permission
  • Not engage in abusive or harmful interactions with AI companions

5. NFT and Digital Asset Terms

5.1 Ownership

When you mint or acquire a MetaMuses NFT, you receive ownership of the NFT as recorded on the Metis blockchain. This ownership grants you the right to use, transfer, or sell the NFT according to these Terms.

5.2 License

NFT ownership grants you a limited, non-exclusive license to display and use the associated digital artwork for personal, non-commercial purposes. We retain all intellectual property rights in the underlying artwork, brand, and Platform.

5.3 Restrictions

You may not:

  • Use NFT artwork to create derivative works for commercial sale
  • Use NFTs in connection with illegal activities
  • Claim trademark or copyright ownership over the artwork
  • Use NFTs in a manner that disparages the MetaMuses brand

6. AI Companion Terms

6.1 AI Limitations

AI companions are powered by machine learning models and may:

  • Produce inaccurate or inappropriate responses
  • Have limitations in understanding context
  • Not be suitable for providing professional advice

6.2 User Conduct

You agree not to use AI companions to generate illegal, harmful, or offensive content. We reserve the right to monitor interactions and suspend access for violations.

7. Blockchain and Transaction Risks

You acknowledge and accept that:

  • Blockchain transactions are irreversible once confirmed
  • Gas fees are required for transactions and are non-refundable
  • Smart contract interactions carry inherent risks
  • The value of digital assets may fluctuate significantly
  • Network congestion may affect transaction processing
  • We are not responsible for losses due to user error or wallet security

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio, software, and the compilation thereof, is the property of MetaMuses or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Accuracy or reliability of content
  • Security from unauthorized access

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, METAMUSES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless MetaMuses and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use after modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Termination

We may suspend or terminate your access to the Platform at our discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform ceases, but provisions relating to ownership, indemnification, and limitations of liability survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
